ACE SPECIAL TRAINS AUTOGRAPHED JERSEY SWEEPSTAKES

OFFICIAL RULES

ELIGIBILITY: The ACE Special Trains Autographed Jersey Sweepstakes (the “Sweepstakes”) is open to legal residents of the State of California, age 18 or older at the time of entry. Void outside the State of California, and wherever else prohibited by law. Employees of the San Joaquin Regional Rail Commission (the "Sponsor"), the San Francisco 49ers, the National Football League, NFL Ventures, Inc., NFL Ventures, L.P., NFL Properties LLC, and their respective parents, subsidiaries, affiliates, advertising and promotion agencies, and the immediate family members of, and/or those living in the same household of each, are not eligible to enter. The Sweepstakes is subject to all applicable federal, state and local laws and regulations.

ENTRY PERIOD:  The ACE Special Trains Autographed Jersey Sweepstakes begins at 12:00 a.m. Pacific Time (“PT)” on 12/03/2024 and ends at 11:59p.m. PT on 12/30/2024 (the “Sweepstakes Entry Period”).

HOW TO ENTER:

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS SWEEPSTAKES AND PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.

There are three (3) ways to enter.

Ride ACE Special Train Service: Ride a Special Train Service on December 08, 2024, and/or or December 30, 2024, using the ACE app and receive ten (10) entries per game. Participants will be entered via the email address used in the ACE app, for up to twenty (20) entries per email address via this method of entry. Multiple tickets purchased on the same account will be counted as one entry.

Facebook and Instagram: If you follow, like, and tag a friend on Facebook or Instagram, you will receive one (1) entry. If you share to your story on Facebook or Instagram, you will receive one (1) entry. Participants will be entered via their social media handle, for up to four (4) additional entries per social media handle.

Entries must be received before the end of the Sweepstakes Entry Period to be eligible for the Sweepstakes drawing. Use of multiple Instagram accounts and/or email addresses by the same individual to enter is prohibited. Use of computer programs and/or other automated devices to enter the Sweepstakes is prohibited. Normal Internet access and usage charges imposed by your online service will apply and are your responsibility. If it is discovered that a participant has attempted to enter with multiple email addresses or under multiple identities or uses any other method or device during the Sweepstakes Entry Period to enter multiple times beyond the limits stated above, such participant will be disqualified.

By Mail: Legibly print your full name, complete mailing address, date of birth, phone number and email address on a postcard with applicable postage and mail to: The ACE Special Trains Autographed Jersey Sweepstakes, 949 East Channel Street, Stockton, CA  95202. Mail entries must be received by 3:00p.m. PT on Tuesday, December 31, 2024.  There is a limit of one (1) mail entries per household.  Mail entries received by 3:00p.m. PT on Tuesday, December 31, 2024, will be added to the random drawing along with other entries received prior to the close of the Sweepstakes Entry Period.

Participants are solely responsible for Internet connectivity, software and/or hardware that may be required in order to submit an entry. Entries must be submitted in accordance with these Official Rules; no other method of entry into this Sweepstakes will be permitted. Entries will not be acknowledged or returned. Entries must be made by an individual only. Group entries are prohibited. By participating in the Sweepstakes, you fully and unconditionally agree to abide by and be bound by these Official Rules and the decisions of the Sponsor, which shall be final and binding in all matters related to the Sweepstakes. Sponsor is not responsible for lost, late, stolen, misdirected, incomplete, illegible, damaged or postage-due entries.

SWEEPSTAKES RANDOM DRAWING & NOTIFICATION: One (1) potential winner will be selected at random drawing to be held on or about 5:00p.m. PT on January 6, 2025, from among all eligible entries received during the Sweepstakes Period. Potential winner will be notified via email or social media and given instructions on how to contact Sponsor to claim their prize. The potential winner must reply to the winner notification from Sponsor within forty-eight (48) hours. If the potential winner is not reachable at the email address or social media handle provided or if the prize notification is returned as undeliverable, then the prize will be forfeited, and an alternate potential winner may be selected at Sponsor’s sole discretion. The odds of winning depend on the total number of eligible entries received during the Sweepstakes Entry Period.

SWEEPSTAKES PRIZE:  One (1) prize will be awarded in total. The Winner will receive (1) unframed, San Francisco 49ers jersey, autographed George Kittle. Actual retail value of the prize is approximately $250.00. Prizes may not be transferred or assigned. No prize substitution will be allowed. Sponsor reserves the right to substitute a prize of equal or greater retail value if any advertised prize becomes unavailable. By accepting a prize, the winner agrees to Sponsor’s use of winner's name, city and state of residence, statements about the Sweepstakes and/or likeness for publicity, advertising and promotional purposes in all media worldwide (including but not limited to social media) without limitation and without further compensation or notice (unless prohibited by law). Winner agrees to photo opportunity at Sponsor’s discretion. If applicable, once the prize or prize element has been delivered to the winner, the prize is considered “awarded.” All entries become the property of Sponsor and will not be acknowledged or returned. By entering, Sweepstakes entrants acknowledge compliance with these Official Rules, including all eligibility requirements. By participating, entrants agree to release the San Joaquin Regional Rail Commission and its affiliates, subsidiaries, divisions, wholesalers, retailers or distributors or advertising and promotion agencies and each of their respective officers, directors, employees, agents or representatives, and the San Francisco 49ers, NFL Ventures, Inc., NFL Ventures, L.P., NFL Properties LLC, and each of their respective parents, subsidiaries, affiliates, shareholders, officers, directors, agents, representatives, and employees (collectively, “Released Parties”) from and against any and all claims, demands, losses and liabilities of any nature whatsoever, which entrant may now or hereafter be entitled to assert, including but not limited to, any death, injury, loss of enjoyment, damage to computer equipment, or other harm or loss of any nature whatsoever caused or contributed to by participation in the Sweepstakes, and/or in connection with the awarding, receipt and use or misuse of the prize (if awarded to him/her/they), and/or claims based on publicity rights, defamation or invasion of privacy. Released Parties are not responsible for (i) entries that are lost, late, stolen, damaged, garbled, destroyed, illegible, postage due or misdirected; (ii) any problems or technical malfunctions, errors, omissions, interruptions, deletions, defects, delays in operation or transmission, communication failures or human error that may occur in the transmission, receipt or processing of entries, or for destruction of or unauthorized access to, or alteration of, entries; (iii) failed or unavailable hardware, network or, software; (iv) causes beyond Released Parties’ reasonable control that jeopardize the administration, security, fairness, integrity or proper conduct of this Sweepstakes; (v) incorrect or inaccurate entry information whether caused by entrants or by any of the equipment or programming associated with or utilized in the Sweepstakes; (vi) any typographical or other error in any printing or advertising related to the Sweepstakes, in the administration or execution of the Sweepstakes, or in the announcement of prize winners, or (vii) cheating or fraud by any entrant.

If for any reason this Sweepstakes cannot be executed as planned, including but not limited to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor that corrupt or affect the security, administration, fairness, integrity or proper conduct of this Sweepstakes, or if this Sweepstakes is compromised or becomes corrupted in any way, electronically or otherwise, Sponsor reserves the right to terminate or modify this Sweepstakes. If this Sweepstakes is terminated before the original end date or modified, the Sponsor will select the prize winner(s) from among all valid, non-suspect entries received as of the time/date of termination of the Sweepstakes and/or after such time/date (if applicable) or otherwise select the winner(s) in a fair manner as determined in the sole discretion of the Sponsor. Sponsor reserves the right, at its sole discretion, to disqualify and prosecute any individual who tampers with or attempts to tamper with the entry process or any aspect of this Sweepstakes. CAUTION: ANY ATTEMPT BY ANY PERSON TO DELIBERATELY CORRUPT OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO DISQUALIFY, PROSECUTE AND SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. Any participant who is notified that he or she has won is the potential winner until Sponsor determines, in its sole discretion, that the participant is eligible to win in accordance with these Official Rules. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. By participating, each entrant agrees that (a) any and all disputes, claims and causes of action arising out of, or connected with, this Sweepstakes or any prize (if awarded to him/her/they) shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate state or federal court, and litigation and/or trials will be decided solely by a judge. ENTRANT WAIVES TRIAL BY JURY IN ANY SUCH ACTION(S); (b) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including but not limited to costs associated with entering this Sweepstakes, but in no event attorneys’ fees; and (c) to the extent allowed by applicable law, under no circumstances will entrants be permitted to obtain awards for, and entrants hereby waive all rights to claim, punitive, incidental, and/or consequential damages and/or any other damages, other than out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU.

IF ENTRANT IS A CALIFORNIA RESIDENT, ENTRANT WAIVES CALIFORNIA CIVIL CODE SECTION 1542, WHICH STATES: “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY” (OR ANY EQUIVALENT STATUTORY PROVISION WITH A SIMILAR IMPORT OR INTENT). IF ENTRANT IS A RESIDENT OF A STATE OTHER THAN CALIFORNIA, ENTRANT EXPLICITLY WAIVES THE TERMS AND PROTECTIONS OF ANY STATUTE OF HIS/HER STATE THAT HAS A SIMILAR IMPORT OR INTENT.

All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, entrants’ rights and obligations, or the rights and obligations of the Sponsor in connection with the Sweepstakes, shall be governed by, construed in accordance with, and subject to the laws of the State of California without giving effect to any choice of law or conflict of law rules, which would cause the application of the laws of any jurisdiction other than California.

The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Sweepstakes-related materials and the terms and conditions of these Official Rules, these Official Rules shall prevail, govern and control.

Data Protection/Privacy Policy: Information collected by Sponsor in connection with the Sweepstakes is subject to Sponsor’s Privacy Policy located at https://acerail.com/privacy-and-security-policy/ and applicable data protection laws. Each entrant agrees to the collection, processing and storage of entrant’s personal data by Sponsor for purposes of the Sweepstakes.

WINNERS’ LIST: To receive name, city and state of residence of prize winner(s), mail a stamped, self-addressed envelope accompanied with a signed, hand-printed request to “ACE Special Trains Autographed Jersey Sweepstakes Winner’s List”, 949 East Channel Street, Stockton, CA  95202. All requests must be received by 5:00p.m. PT on December 31, 2024.

This Sweepstakes is not sponsored, endorsed or administered by, nor associated with Instagram, Facebook, the San Francisco 49ers, or the National Football League. You understand that you are providing your information to Sponsor and not Instagram, Facebook, the San Francisco 49ers, or the National Football League and that by entering the Sweepstakes, you release Instagram, Facebook, the San Francisco 49ers, and the National Football League from any claim regarding the Sweepstakes.
